I am not sure I feel comfortable enough to drill out the holes to apply a bolt and lock nut. I am afraid I would mess the bracket up. I have called 2 Grady dealers, a yamaha repower dealer and all directed me to call the factory. I called them and was advised to call a dealer. I believe it's the factory bracket. The boat is a 2000 model year.

Perhaps the best thing to do would be to post a picture of what your setup currently looks like? Someone with the same or similar boat might then be able to give you some more solid advice?
Looks like mine are the same way, on a 2000 Seafarer. Also looks like there should be plenty of room if they had to be drilled through. Take the inspection plate off the top of the bracket, and take pics of what you see in there. 
Thank you very much for the picture, helps as I didn't know if the bolts used a lock washer or threadlock. I assume they put some sealant on the bolt as well? I will take a picture as soon as the rain lets up. I did look in the holes and it seems like the threads do not go all the way to where it ends. It seems as if there is an inch or so of threads.
Was able to open the access plate on the bracket and take pictures. When I pulled the access plate, there was no silicone/sealant under it. No water in there other then condensation, should I apply sealant to to plate when finished?

Is the threaded hole inside the two b&d shapes? Also, is the front of the bracket aluminum, or is the fiberglass of the transom the only front? Pic of the top bolts inside, also the drain plug in the bottom?
I am not home currently to take a picture but found a picture I can use. You can see the top bolts mounted with a nut on the top of the bracket, not inside

My 2004 228 had the bracket like that. It was a "Gil" bracket and the inspection plate looked just like yours. On the under-side there is an O-ring setting in a groove and seals when it is tightened down. Be sure to grease the threads on the screws when you put them back. If yours has no groove and no O-ring then it will need some sealant.

There was no groove or o ring, I will be applying sealant once everything is done. I appreciate all the help.

Somethign doesn't add up to me. If someone wanted old electronics, I guess that could happen. Why remove bolts unless you were intending to take the part itself. Even weirder, why fill the holes with silicone? Just seems weird. Hopefully the boat is outta there and in a safe spot now. I'd work the dealer and find out why this is happening and why they are not making it right. 2 bolts seem like an easy fix for a marina to do for somebody to keep the peace.
